JS&J CLUB TERMS AND CONDITIONS

  1. Eligibility

Membership in The JS&J Club (the “Club”) is limited to individuals. No corporate or group memberships are permitted. Limit one (1) Club membership per person.

 

  1. How to Participate

To participate in the Club, enroll online (the “Site”) and set up a Club account (an “Account”) in accordance with the on-screen instructions. J. S. & J. Travel Connection Inc. customers who enrol in the Club are referred to herein as “Members”.

 

  1. General Conditions

The Club is sponsored and administered by J. S. & J. Travel Connection Inc. Membership in the Club is subject to these JS&J Club Terms and Conditions (the “Terms and Conditions”).

J. S. & J. TRAVEL CONNECTION INC. reserves the right to alter or modify the Club at any time in J. S. & J. TRAVEL CONNECTION INC.’s sole discretion without notice to Members, including without limitation, the right to add, modify, delete or otherwise change any provision of the Terms and Conditions or any aspect of the Club, including without limitation, any procedure, the Levels, the number of JS&J Points required for any Level, the method of earning JS&J Points, and the Benefits, each as defined below. J. S. & J. TRAVEL CONNECTION INC. further reserves the right to terminate the Club at any time without notice to Members. Since any changes will be posted on this page, Members should check this page regularly. Continued membership in the Club following any changes to these Terms and Conditions constitutes acceptance of such changes.

J. S. & J. TRAVEL CONNECTION INC. reserves the right to audit any Member’s Account at any time. J. S. & J. TRAVEL CONNECTION INC. reserves the right, in its sole discretion, to discontinue participation for any Member who acts or is reasonably suspected of acting in any manner which is inconsistent with or violates these Terms and Conditions or any portion of the Club. J. S. & J. TRAVEL CONNECTION INC. also reserves the right to discontinue participation for any Member who (i) acts or is reasonably suspected of acting in a fraudulent, dishonest or improper manner in connection with the Club; (ii) acts in a manner that is deemed detrimental to the Club, as determined by J. S. & J. TRAVEL CONNECTION INC. in its sole discretion; or (iii) is ejected from any J. S. & J. TRAVEL CONNECTION INC. booking for any reason. J. S. & J. TRAVEL CONNECTION INC.’s termination in a Member’s membership will result in immediate forfeiture of all JS&J Points accumulated. J. S. & J. TRAVEL CONNECTION INC.’s decisions and interpretations of these Terms and Conditions shall be within J. S. & J. TRAVEL CONNECTION INC.’s sole discretion and are final and binding. Members are responsible for remaining knowledgeable as to the Terms and Conditions. J. S. & J. TRAVEL CONNECTION INC. is not responsible for incorrect or inaccurate transmission of information regarding the Club, or problems related to any of the equipment or programming associated with the Club.

 

  1. Earn JS&J Points

Members in good standing will receive JS&J Points when their referrals complete a cruise booked by J. S. & J. TRAVEL CONNECTION INC in accordance with the point system in effect at the time of booking by the referral. JS&J Points may not be awarded for certain charters and/or non-revenue fares, as reasonably determined by J. S. & J. TRAVEL CONNECTION INC..

Except as otherwise stated herein, JS&J Points are credited to a Member’s Account within fourteen (14) days of their referral completing a cruise booked by J. S. & J. Travel Connection Inc.. Members can check their JS&J Point balance by logging into their Account on the Site. J. S. & J. TRAVEL CONNECTION INC. may, from time to time at its sole discretion, offer opportunities to earn extra JS&J Points through participation in different promotions.

Members will be deemed a certain “Level” in the Club depending on the number of the completed cruises during the year, which were booked by J. S. & J. Travel Connection Inc. The following number of cruises booked by J. S. & J. Travel Connection Inc. must be completed by referrals to be awarded the corresponding Level. A Member will be a deemed a “Regular” Level Member upon Member’s registration for the Club and such Member will be deemed a “Gold” Level Member once the Member has ten (10) or more, but less than twenty (20) of their referrals completing cruises booked by J. S. & J. Travel Connection Inc. during the year. Members will be deemed a “platinum” Level Member once the Member has twenty (20) or more of their referrals completing cruises booked by J. S. & J. Travel Connection Inc. during the year. The Levels are reset at the end of each year and determined by the performance during the year just ended.

     5. Disclaimer and Limitations

Neither J. S. & J. TRAVEL CONNECTION INC., nor its parent, subsidiaries or affiliated companies will be responsible for any loss, injury or damage of any kind incurred by Member or anyone else in connection with Member’s participation in the Club.

THE CLUB IS OFFERED “AS IS” AND “AS AVAILABLE.” J. S. & J. TRAVEL CONNECTION INC. MAKES NO WARRANTIES EXPRESS OR IMPLIED WITH RESPECT TO THE CLUB AND J. S. & J. TRAVEL CONNECTION INC. HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, REGARDING THE CLUB, AND ANY PURCHASES OR BENEFITS, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. J. S. & J. TRAVEL CONNECTION INC. SHALL NOT BE LIABLE TO ANY MEMBER OR OTHER PERSON FOR ANY DIRECT, COMPENSATORY, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, WHETHER IN AN ACTION IN CONTRACT OR TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, WARRANTY, STATUTORY RIGHTS OR ANY OTHER BASIS ARISING OUT OF, OR CONNECTED WITH, THE CLUB, OR ANY BENEFITS, EVEN IF J. S. & J. TRAVEL CONNECTION INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR IF SUCH DAMAGES WERE FORESEEABLE. IN THE EVENT ANY OF THE FOREGOING LIMITATIONS OF LIABILITY ARE VOID OR NOT EFFECTIVE, MEMBER AGREES THAT THE TOTAL LIABILITY OF J. S. & J. TRAVEL CONNECTION INC. SHALL IN NO CASE EXCEED $25.

  1. Club Benefits

Members who achieve a certain Level may be entitled to certain benefits (“Benefits”) during each booking. Benefits are subject to change at any time without notice to Members. Except for any termination reasons mentioned above, once the Member has reached a certain Level, the Member may maintain such Level while booking Cruises with J. S. & J. TRAVEL CONNECTION INC during any given year.

  1. Questions or Complaints

The Club is administered by J. S. & J. Travel Connection Inc..  If Members have any questions or complaints regarding the Club, please contact J. S. & J. TRAVEL CONNECTION INC. directly at 1.246.434.5575.

 

  1. Miscellaneous
  • Unless otherwise expressly stated herein, JS&J Points and Benefits may not be assigned, sold or otherwise transferred by the Member, by operation of law or otherwise.
  • JS&J Points have no cash value.
  • The Club is subject to all applicable laws and regulations and is void where prohibited by law.
  • By participating in the Club, Members consent to and authorize J. S. & J. TRAVEL CONNECTION INC. to collect information about the Member in accordance with the terms of the Privacy Notice.
  • All interpretations of these Terms and Conditions as well as questions or disputes regarding participation in the Club, JS&J Points, or Benefits shall be resolved by J. S. & J. TRAVEL CONNECTION INC. in its sole discretion.
  • Accumulated JS&J Points are not Member’s property and may be revoked, cancelled, limited or modified at any time.
  • These Terms and Conditions constitute the entire understanding between J. S. & J. TRAVEL CONNECTION INC. and Member with respect to the Club, and supersede any and all prior communications, whether written or oral.
  • Disputes/Choice of Law: Except where prohibited, each Member agrees that: (i) all issues and questions concerning the Club shall be governed by Barbados law without giving effect to any principles of conflicts of law of any jurisdiction; (ii) any and all disputes, claims and causes of action at law or in equity arising out of or relating to the Club shall be (1) resolved individually, without resort to any form of class action; and (2) filed only in the state or courts situated in Barbados and hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (iv) under no circumstances will any Member be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
  • While J. S. & J. TRAVEL CONNECTION INC. will use its best efforts to ensure accuracy of Club information, printing errors occasionally occur. J. S. & J. TRAVEL CONNECTION INC. reserves the right to correct such errors at any time in its sole discretion.

List of Benefits of the JS&J Club

Benefits are subject to the provisions in the JS&J Club Terms and Conditions. All capitalized terms herein have the same meaning as those set forth in the JS&J Club Terms and Conditions. No substitution of Benefits may occur, except in the sole discretion of J. S. & J. TRAVEL CONNECTION INC. Benefits are subject to change at any time without notice.

  • Eligible to receive Members-only specials, offers, promotions or discounts which may be offered by J. S. & J. TRAVEL CONNECTION INC. from time to time in its sole discretion (“Member Offers”).
